Waiver, Cancellation & Payment

Everything you agree to when you train with Declan, in plain language — what the risks are, how photo and video use works, and what happens when a session needs to move. Read it here, sign it on paper at your session.

Nothing on this page is signed online. This is a reading copy of Declan Alenda Basketball Training's policies, published so you can go through everything in advance. It is not a form and not a legal contract — there is nothing here to fill in, tick, or submit.

Declan brings the printed waiver and release forms to sessions. Every athlete — or their parent or legal guardian, if the athlete is under 18 — must read and physically sign those forms before training begins. Reading this page does not replace that signature, and the summaries below are shortened for clarity: the signed forms are the versions that count.


Section A

Liability Waiver & Release

Basketball training is a physical activity. The clauses below describe the risks involved, what you release by choosing to participate, and the authorization Declan needs in order to act quickly if an athlete is ever hurt.

1 · Assumption of Risk

Basketball training involves inherent risks of injury that cannot be eliminated no matter how carefully a session is run. These include, but are not limited to:

  • Slips, trips, and falls on the court
  • Collisions with other athletes, equipment, walls, or standards
  • Contact with the ball, including impact to the hands, face, or head
  • Sprains, strains, fractures, and other muscle, joint, or bone injuries
  • Overexertion, dehydration, heat illness, cardiac events, and fainting
  • In rare cases, serious or permanent injury

By participating, the athlete and their parent or legal guardian confirm that they understand these risks, that participation is entirely voluntary, and that they knowingly and freely assume all such risks — both known and unknown. They also confirm the athlete is physically fit and has no medical condition that would make training unsafe.

2 · Release of Liability

In exchange for being allowed to participate, the athlete and their parent or legal guardian release, waive, and discharge Declan Alenda and Declan Alenda Basketball Training — along with any assistants, facility owners, and property owners where sessions are held — from any and all claims, demands, or causes of action for injury, illness, death, or property loss arising out of participation in training.

This release covers ordinary negligence. It does not release, limit, or waive liability for gross negligence, recklessness, or willful or intentional misconduct, and it does not waive any right that cannot be waived under California law.

3 · Medical Authorization & Emergency Treatment

If an athlete is injured or becomes ill during a session, Declan will make every reasonable effort to reach the parent or legal guardian right away using the contact information on file.

If a parent or guardian cannot be reached, they authorize Declan to summon emergency medical services and to consent, on their behalf, to any emergency examination, first aid, transport, anesthesia, or treatment that a licensed physician, paramedic, or emergency technician judges necessary. The parent or legal guardian remains responsible for all resulting medical, ambulance, and hospital costs, which are not covered by Declan Alenda Basketball Training.

Please keep current emergency contact details, allergies, medications, and relevant medical conditions on file, and let Declan know as soon as anything changes.

Separate & optional

Photo & Video Release

This permission is completely separate from the liability release above and is entirely optional. It is agreed to on the printed form, on its own line, with its own tick box and its own signature — never bundled into the liability release. Declining it has no effect whatsoever on an athlete's ability to train, on pricing, or on scheduling.

There is nothing to opt into on this page. The wording below is shown only so you know what you will be asked, and is quoted from the paper form Declan brings to sessions. You make the choice there, in person, by ticking the box or leaving it blank.

If — and only if — you tick that box, you grant Declan Alenda Basketball Training permission to photograph and record training sessions, and to use that footage to promote the program: on this website, on social media including Instagram, and in other promotional material. No payment is made for this use, and names and other personal details are never published alongside the media without separate permission. Leaving it blank declines it, and no explanation is needed.

Wording on the printed form

"I grant permission for photos and video of the athlete to be used for marketing and promotional purposes."

You may withdraw this permission at any time by emailing declan.alenda@gmail.com. Declan will stop using the media going forward and remove it from any channel he controls, though material already printed or reshared elsewhere may not be fully recoverable.


Section B

Cancellation & Payment Policy

Every booked slot is time held exclusively for one athlete, which is why notice matters. The aim here is simple and fair in both directions: respect each other's time, and nobody loses money over an honest scheduling change.

1 · 24-Hour Cancellation Notice

Cancellations and reschedules require at least 24 hours' notice before the session start time. With that notice, the session moves at no cost.

Cancellations inside 24 hours, and no-shows, are forfeited and charged in full — a package session is deducted, and a single session is billed at the regular rate. The slot was reserved and can no longer be offered to anyone else.

2 · Late Arrivals

Sessions end at their scheduled time regardless of when the athlete arrives. Arriving 15 minutes late means a 15-minute-shorter session, not a later finish, because the following slot belongs to another athlete. Late arrivals are charged in full. If you are running behind, a quick text is always appreciated.

3 · If Declan Cancels

If Declan needs to cancel a session for any reason — illness, travel, weather, or facility closure — the client receives a full reschedule at no charge or a full session credit, whichever they prefer. No session is ever lost because of a cancellation on Declan's end.

4 · Session Packages

Package sessions (the 4-pack and the 8-pack) are valid for 90 days from the date of purchase. Any sessions left unused after 90 days expire. Packages are paid up front, and the discounted per-session rate reflects that commitment.

Packages are for one athlete and cannot be split between athletes or transferred, unless Declan agrees to it in writing beforehand.

5 · Refunds

All sales are final — there are no cash refunds on single sessions or packages. Where an adjustment is warranted, it is resolved with a session credit or a reschedule rather than money back.

6 · Illness & Injury Exceptions

Genuine illness and injury are treated reasonably. If an athlete cannot train because of a documented illness or injury — a doctor's note, urgent care paperwork, or similar documentation — Declan will waive the late-cancellation charge and, where recovery runs long, extend a package's 90-day window by a reasonable period.

Please reach out as early as you can. These exceptions are applied case by case and in good faith; they are meant for real medical situations rather than routine schedule changes.

And to say it once more: this page is just the reading copy. Declan hands you the printed waiver and release forms at your first session, and they need to be signed before the athlete steps on the court. If you would rather read and sign them ahead of time, email him and he will send them over.
